Governor Martinez acted on HB 2, the General Appropriations Act, by signing it. However, she line-item vetoed the entire section of the act which funded the Legislative branch of government and the entire section funding all New Mexico higher education institutions.
The budget for the New Mexico State Library, including grants-in-aid programs, was passed without line-item vetos, except for a $75,000 item added by the Legislature which would have enabled schools to participate statewide in the national history day program.

Governor Martinez also vetoed a separate bill which raised the gasoline tax and made other revenue-enhancing provisions to the tax code.

It is certain that there will be a special session of the Legislature to fix this untenable situation.
